Return and Exchange Policy for "OODDSS" E-Commerce Platform in Accordance with Kuwaiti Commercial Law

"OODDSS" E-Commerce Platform places great importance on the comfort and satisfaction of its customers regarding the products purchased through the website. This guide aims to provide clear policies for consumers regarding the process of returns and exchanges, in compliance with Kuwaiti commercial law to protect consumer rights and enhance trust in online shopping. "OODDSS" is also committed to protecting its legal and commercial rights at all stages of the return and exchange process, ensuring no practices that may harm its interests or breach the specified terms.


1. Exchange and Return in Case of Defects or Damage:

  • If the customer receives a product with defects or damage not caused by usage, they have the right to exchange or return it within 14 days of receiving the product.

  • The customer must provide a photo of the defect or damage on the website or via customer service, and the condition will be verified before approving the exchange or return.

  • If the return or exchange is approved, the paid amount will be refunded in full or a new product will be sent, depending on the customer’s choice.

  • All return or exchange shipping costs in this case will be borne by the platform.


2. Exchange or Return Due to Change of Mind:

  • The customer has the right to return or exchange the product in case of a change of mind, subject to the following conditions:

    • The product must be in its original condition without being opened or used.

    • The product must be packed in its original packaging, including accessories and any documents or warranties.

    • The paid amount for the product will be refunded (excluding shipping costs) in case of return, or it will be exchanged for another product of similar value.

    • The return or exchange policy due to change of mind does not apply to custom-made or modified products.


3. Products Not Eligible for Return or Exchange:

According to Kuwaiti commercial law, there are some products that cannot be returned or exchanged, including:

  • Products with opened original packaging: such as cosmetics, underwear, or any product whose packaging has been opened.

  • Food or perishable products: such as food, beverages, dietary supplements, or any product with an expiry date or that has expired.

  • Software or digital content: such as programs, games, or downloadable content after it has been used or downloaded.

  • Custom-made products: such as clothes or shoes made specifically for the customer, or products that have been modified based on the customer’s request.

  • Products with limited shelf life or perishable materials: such as medicines or dietary supplements that may deteriorate after the packaging is opened.

  • Electronics that have been activated or opened: such as phones or devices that contain activation codes after being used.

  • Products with tamper-proof seals: such as items with holograms or security labels that have been tampered with.

  • Products used outside the recommended usage: such as tools or devices that have been used in an unreasonable manner or tampered with.


4. If the Error is on the Buyer’s Side:

  • The platform is not obligated to resend the order for free: If there is an error on the part of the customer, such as incorrect address details or an incorrect order.

  • The customer bears the additional delivery cost: In case of an error by the customer, the customer will bear the cost of reshipping or sending the item again.

  • The platform reserves the right to refuse a full refund: If the product was opened or damaged during the first delivery due to the customer’s mistake.


5. Return or Exchange Process:

To complete the return or exchange process, the customer must follow these steps:

  1. Contact customer service via email or phone within 14 days of receiving the product.

  2. Provide product details (order number, product name, reason) and clear images if there are any defects or damage.

  3. If approved, instructions will be sent for returning the product. The customer must return the product in its original condition.

  4. Once the returned product is received and inspected, the return or exchange process will be completed, depending on the customer’s choice.


6. Platform’s (Seller’s) Rights Regarding Return and Exchange:

Under Kuwaiti commercial law, the seller (OODDSS platform) has the right to determine the return and exchange conditions in the following cases:

  • Refuse return or exchange if the product has been opened or used: If the condition of the product has changed after the customer received it, the seller may refuse the return or exchange.

  • Refuse return in case of delay: If the customer exceeds the 14-day period for return or exchange, the seller has the right to refuse the request.

  • Refuse return or exchange if the product has been tampered with or altered: If the product has been tampered with, labels removed, or used in a way that affects its original condition, the seller can refuse the return or exchange request.

  • Right to inspect the product: The seller may inspect the returned product to verify its condition before making a decision on the return or exchange. If the product has been used in a way that affects its condition or value, the seller may refuse the request.


7. Consumer Rights:

"OODDSS" is committed to applying consumer rights in accordance with Kuwaiti commercial law and emphasizes that this policy does not diminish the legal rights of consumers as stipulated by Kuwaiti law.


8. Financial Refund:

  • In case of return, the amount paid will be refunded through the same payment method used during the purchase process.

  • The execution of the return or exchange process may take from 7 to 14 business days after the returned product is received and inspected.


9. Shipping Costs:

  • In case of exchange or return due to product defects or damage, "OODDSS" will bear the shipping costs.

  • In case of return or exchange due to a change of mind, the customer will bear the shipping costs for returning the product.
